GiftPact Foundation Inc. (GiftPact) believes that respect for your privacy and personal information is foundational to our business. We have prepared this privacy policy to explain the manner in which we collect, use and disclose personal information when you access our website at www.giftpact.com, use our donor portal, distribute to a qualified donee or otherwise interact with us.
1. Use and Disclosure of Personal Information
GiftPact is registered as a public foundation that assists families and institutions with their philanthropic objectives. We are committed to protecting the privacy of personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).
To become a GiftPact donor, you must enter into a donor-advised agreement, which by signing, you are giving GiftPact permission to collect and use the information in order to fulfill its obligations to you. GiftPact takes reasonable steps to ensure that donors are aware of the purposes for which the information is collected. If you are one of our donors, we will collect your name, address, phone number, and email address. We also collect personal information that is necessary to verify the identity of individuals, who you may have named as authorized representatives on your donor-advised fund.
We use the information collected to:
- Open your donor-advised fund
- Issue charitable tax receipts
- Receive donations to your fund
- Report to you on your funds
We may provide your contact information to the registered charities you have recommended as grant recipients if you have provided us permission to do so. We will share information to service providers that we have engaged to provide operational and administrative support on your behalf. We will collect only that information which is necessary and will restrict the information to those individuals who need access to it in the performance of their duties in facilitating the donation of securities, assisting your professional advisors in tax planning, or underwriting, administering and processing claims under a related policy.
GiftPact does not sell, rent, license, or trade your personal information in any manner or with third parties. We will only disclose personal information if this is required by law or permitted under PIPEDA, which may include assisting in law enforcement.
We may request further information about you or your philanthropic objectives to better serve you, but you are not obligated to provide such information.
2. Website and Donor Portal
Our website uses cookies and gathers and analyzes information (such as pages most read, search terms and other engagement details) to examine and improve the user experience and the website.
If Canada’s Anti-Spam Legislation (CASL) applies to any communications that GiftPact has with donors, GiftPact will comply with any provisions of CASL regarding sending commercial electronic messages.
3. Safeguards and Retention
We protect all personal information we hold from misuse and loss and from unauthorized access, modification, or disclosure. This protection applies to information stored in both electronic and hard copy form. We have implemented reasonable administrative, technical and physical measures to safeguard the personal information in our custody. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfill their job requirements.
Our website may offer links to other third-party websites. You should familiarize yourself with the particular privacy policies of those websites.
A user may withdraw their consent to use their personal information at any time, but subject to any legal or contractual restrictions.

Individuals should provide as much detail as possible about the particular information sought in order to help us retrieve it. An access fee may be charged to cover our costs of providing the information.
For legal and administrative reasons, we may also archive non-current records containing personal information, such as backup data files and off-site storage.
